Rental conditions

Please read the Rental Conditions carefully before filling in the booking form.

1. Introduction
The rental conditions refer to holiday accommodations rental at the prices indicated in the price-list. The minimum rental period varies according to the different accommodations offered, pls check it in each property web page.

2. Reservation, Confirmation and Payment Conditions

Bookings shall be considered valid under the following conditions: 
a) The client has filled out and sent the on-line booking form, following that Tuscanyholidayrent will send a confirmation of booking.
b) Advance payment of 30% of the total due, at booking confirmation. 
c) The total balance is due by and no later than 30 days before the start of rental.
d) Payment can be made by means of bank transfer, paypal on line, or by means of VISA/MASTERCARD. 
Please note: fax, e-mail or telephone bookings shall remain valid for maximum 48 hours. The payment due and the form duly filled out and signed must be received within this time: booking can otherwise be cancelled. 

3. Various Conditions
On receipt of the deposit of 30% we shall send the client a payment receipt. On receipt of the balance we shall send the client the voucher for his booking which must be handed to the renter so as to take possession of the rented unit, valid for the names and the period written thereon. It is prohibited to transfer the voucher to others or to show up in a greater number of people than those indicated in the voucher, given that the apartment occupation is limited to the number of persons mentioned in the voucher. The owner can refuse access to the persons in excess. 

4. Arrival and Departure
Arrivals are expected on the arrival day between 3.30 pm and 7:30 pm. Departures must be effected on the departure day by and no later than 10:00 am. If the arrival of the client is not possible within the hours indicated the client must inform the keyholder at the number indicated on the voucher, so that a new meeting time can be arranged. If the keyholder is not informed he cannot be held responsible for eventual problems on the delivery of the keys. If the client is unable to occupy the apartment on the arrival day or the hour expected, for difficulties during the journey, strikes or personal problems there is no possible reimbursement. The same rule applies for an early departure.

5. Damage Deposit
On arrival, the client must pay the owner or his appointee a deposit as specified in the price-list. The deposit will be returned at the time of departure, but for holding back sums owed for any damage caused or for expenses not included in the contract (telephone, heating, etc.). In the event this payment is not made, the person responsible reserves the right to refuse the keys. 

6. Your Liability
The tenant undertakes to occupy the accommodations respecting the rules of a good neighbor. The client himself must see to cleaning dishes and kitchen materials, as these are not included in the final cleaning.

7. Complaints
The apartments are handed over to the client clean and in order. The condition of accommodations correspond to the catalogue description updated on the basis of information provided by the owners. The apartments are equipped with the comforts explicitly listed in the catalogue. The client who does not intend to accept the condition of the rented accommodations must do so at the moment he enters, in the presence of the renter or his appointee and, in the event of a serious matter, also to Tuscanyholidayrent Staff who can be reached by the owner. If the client leaves the unit rented before speaking with Tuscanyholidayrent appointee, he loses all right to a possible reimbursement. Any other claim must be made to Tuscanyholidayrent within 10 days from check out, Otherwise the client loses right to reimbursement.

8. Changes or Cancellation
Cancellation Norms: Should the client decide to cancel his booking, he shall be entitled to a reimbursement of the price paid after withholding the following percentages

Apartments, B&B or hotel rooms, Farm holidays, residences:  
- 10% of the total price, if the cancellation is received before 60 days of the start of stay 
- 30% of the total price between the 59th day and the 40th day before the start of stay 
- 100% if the cancellation is received within 39 days prior to the start of stay. 

Villas and detached houses.
- 10% of the total price, if the cancellation is received before 90 days of the start of stay 
- 30% of the total price between the 89th day and the 50th day before the start of stay 
- 100% if the cancellation is received within 39 days prior to the start of stay. 

The cancellation must be made in writing (email or fax).
Tuscanyholidayrent reserves the faculty to substitute the accommodations booked with an offer of equal value in the event of serious unexpected occurrence. In the event of force majeure (war, natural calamity, fire, etc.), on the other hand, Tuscanyholidayrent can cancel the contract and reimburse the sum paid. 

9. Law and Jurisdiction
For any legal controversies, the Court of Massa Carrara shall have exclusive competence. Confirming the booking itself implies knowledge of the rental conditions and involves their acceptance without reserve or exceptions. The person who signs the form shall be held responsible for the rental. A compulsory announcement about the law L.269/98 art.16: this law punishes with imprisonment for offences regarding prostitution and juvenile pornography, even if they are committed in a foreign country. 

10. Prices
Fees are expressed as weekly or daily, usually from Saturday to Saturday, for all apartments and villas, and include the rent for the number of persons provided in the catalogue. Some additional costs can be foreseen and mentioned in the “rentals details and conditions” section (such costs may be intended for bed and bath linen, consumption of water, electricity, gas for cooking and/or heating, final cleaning etc). Any additional costs are stated on the voucher and paid to keyholder. B&B and Hotel Prices are expressed as per person and daily.

11. Accommodation Services
Most properties do not admit animals. Please consult the “apartment utilities” section and, in any event, notify the presence of pets before confirming booking. Failure to declare the presence of animals shall give rise to immediate booking cancellation with no right to reimbursement. In properties with swimming-pools, the period of availability can be specified in the “residence utilities” section and is subject to atmospheric conditions. If the opening period is not mentioned, pls. ask by email to our staff. The period for the operation of heating is regulated by the Italian law and only in special cases of climatic adversity is the competent province delegated to make any exceptions. Please note that the cost of heating in Italy is generally much higher than in other countries.
